These Terms and Conditions govern your access and use of Plight Hero, LLC's Services.
Welcome to Plight Hero, LLC. These Terms and Conditions constitute a legally binding agreement between you and Plight Hero, LLC, governing your access to and use of our websites, mobile applications, and related services. By accessing or using the Services in any manner, including visiting or browsing the website or engaging our delivery services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.
Plight Hero operates as a technology-enabled logistics and courier platform that facilitates connections between customers, businesses, and independent delivery drivers for the purpose of arranging on-demand and scheduled delivery services. Plight Hero does not itself transport goods, act as a carrier, or take physical possession of items. Instead, the platform enables users to submit delivery requests, allows drivers to accept or decline those requests, and provides digital tools to coordinate, track, and document deliveries.
These Terms may be updated from time to time by Plight Hero in its sole discretion. Changes will be effective upon posting, and your continued use of the Services constitutes acceptance of the revised Terms. You are encouraged to review these Terms periodically to remain informed of your rights and obligations.
Access to and use of the Plight Hero platform is available only to individuals and business entities that meet all applicable legal, contractual, and operational requirements. By creating an account or using the Services, you represent and warrant that you are at least eighteen years of age or the age of majority in your state or jurisdiction of residence and that you possess the full legal authority and capacity to enter into binding agreements under United States law. You further agree that your use of the Services will comply with all applicable federal, state, and local laws, regulations, and ordinances.
Plight Hero reserves the right, at its sole discretion, to verify user eligibility at any time and may deny access to or terminate the use of the Services if eligibility requirements are not met, if information provided is inaccurate or misleading, or if continued access would expose Plight Hero, other users, or third parties to legal, operational, or security risks.
Drivers using the platform must satisfy additional eligibility standards designed to protect safety, service quality, and regulatory compliance. These requirements include maintaining a valid driver's license appropriate for the vehicle used, maintaining current vehicle registration and insurance that meet or exceed state-mandated minimums, and remaining in compliance with all traffic and safety laws. Drivers must also successfully complete identity verification processes and consent to background checks, which may include criminal history, driving records, and other legally permissible screenings. Failure to meet or maintain these requirements may result in suspension or permanent removal from the platform.
Businesses registering for Business Accounts must provide accurate and complete legal business information, including their registered business name, tax identification number, and authorized contact details. The individual creating or managing a Business Account represents that they are duly authorized to bind the business entity to these Terms and any related agreements. Plight Hero may request additional documentation to verify business legitimacy, authority, or creditworthiness.
Plight Hero offers multiple account types to ensure that platform access, permissions, and features align with each user's role and responsibilities. Customer Accounts are intended for individuals or organizations requesting delivery services through the platform. These accounts enable users to submit delivery requests, manage orders, track deliveries in real time, communicate with drivers, and complete payments through supported payment methods.
Driver Accounts are designed exclusively for independent contractors who use the platform to access delivery opportunities. Driver Accounts store personal identification details, verification records, vehicle information, and payment preferences. Access to platform features is limited based on role, and Drivers are granted only the permissions necessary to accept, complete, or decline delivery requests and manage earnings and payouts.
Business Accounts are intended for organizations that require delivery services at scale or on a recurring basis. These accounts may include enhanced administrative tools, multi-user access, consolidated billing, reporting features, and eligibility for deferred payment or invoicing options, subject to approval. Business Accounts are governed by these Terms as well as any additional commercial terms or billing agreements established between Plight Hero and the business entity.
Users are solely responsible for maintaining the confidentiality and security of their account credentials, including usernames, passwords, authentication tokens, and any access methods associated with their account. You agree not to share your login credentials with any third party or allow unauthorized individuals to access your account. Any activity conducted through your account will be deemed authorized by you, whether or not you personally performed such activity.
Plight Hero implements reasonable and industry-standard security measures to protect the integrity of the platform. However, no system can be guaranteed to be completely secure. Users must promptly notify Plight Hero if they become aware of or suspect any unauthorized access, data breach, or compromise involving their account.
Plight Hero reserves the right, in its sole discretion, to suspend, restrict, or terminate any account at any time and for any reason, including but not limited to violations of these Terms, suspected fraud, misuse of the platform, unsafe conduct, failure to meet eligibility requirements, non-payment of fees, legal or regulatory obligations, or actions that may harm Plight Hero, its users, or third parties.
Users may request account deactivation or deletion at any time through available account management tools. However, certain information may be retained after account termination as required by law or for legitimate business purposes. Termination of an account does not relieve a user of obligations incurred prior to termination, including payment obligations, indemnification responsibilities, or liability for violations of these Terms.
The Services include, but are not limited to, order creation and management, automated driver matching based on availability and proximity, real-time delivery tracking, estimated arrival times, in-app notifications, messaging functionality, payment processing, and delivery confirmation. Certain services may be offered as standard, expedited, urgent, or scheduled deliveries depending on availability, location, and operational conditions.
Plight Hero reserves the right to modify, suspend, limit, or discontinue any aspect of the Services at any time without prior notice. Services are currently available only within authorized regions of the United States, and any use outside of approved service areas is strictly prohibited.
Plight Hero functions solely as a neutral technology intermediary. Customers and Businesses request delivery services through the platform, and Drivers, acting as independent contractors, choose whether to accept such requests. Plight Hero does not guarantee that a delivery request will be accepted, completed within a specific time frame, or completed at all.
Users acknowledge that delivery times, routing, pricing, and availability may vary due to traffic conditions, weather, driver availability, operational constraints, or other factors beyond Plight Hero's control. Estimated delivery times are estimates only and are not guaranteed. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between Plight Hero and any Driver, Customer, or Business.
Plight Hero strictly prohibits the use of its platform for the transportation or delivery of illegal, hazardous, or restricted items. This includes, but is not limited to, illegal drugs, controlled substances, hazardous materials, explosives, firearms, ammunition, counterfeit goods, stolen property, and any items prohibited by federal, state, or local law. Live animals, perishable goods requiring special handling, or items exceeding size or weight limitations may also be prohibited unless expressly authorized by Plight Hero.
Plight Hero makes reasonable efforts to maintain platform availability but does not guarantee uninterrupted, secure, or error-free access to the Services. Temporary interruptions may occur due to system maintenance, updates, technical failures, third-party service outages, network disruptions, or circumstances beyond Plight Hero's control. Plight Hero shall not be liable for delays, losses, or damages resulting from service interruptions or technical errors.
Plight Hero reserves the right, at its sole discretion, to refuse, cancel, or terminate any delivery request or service at any time. This may occur for reasons including, but not limited to, safety concerns, suspected fraud, prohibited items, incomplete or inaccurate information, lack of driver availability, legal requirements, or violations of these Terms. Cancellation of a delivery may result in applicable cancellation fees as disclosed prior to order confirmation.
You agree to provide accurate, complete, and current information at all times when using the Services. This includes, but is not limited to, correct pickup and dropoff addresses, valid contact information, accurate item descriptions, delivery instructions, business details, and payment information. Plight Hero is not responsible for losses, damages, delays, or failed deliveries caused by incorrect, incomplete, misleading, or outdated information provided by users.
You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the platform to request, facilitate, transport, or deliver items that are illegal, unsafe, restricted, or otherwise prohibited by law or by Plight Hero policy. Plight Hero reserves the right to refuse, cancel, or terminate any delivery request that it reasonably believes violates applicable laws or these Terms.
You agree not to misuse, interfere with, or disrupt the operation of the Services or the underlying technology. This includes attempting to gain unauthorized access to the platform, reverse engineering or decompiling software, bypassing security measures, scraping data, introducing malware, manipulating pricing or routing systems, or using the Services for fraudulent, deceptive, or abusive purposes. You may not use the Services in any manner that harms, threatens, harasses, or endangers other users, Drivers, or Plight Hero personnel.
You are solely responsible for ensuring that all items submitted for delivery are properly packaged, safe to transport, and suitable for courier delivery. Items must be packaged in a manner that prevents damage, leakage, contamination, or risk during transit. Plight Hero does not inspect delivery contents and does not assume responsibility for the nature, condition, legality, or packaging of items being transported.
By using the Services, you agree to pay all fees and charges associated with delivery requests placed through the Plight Hero platform. Fees are calculated based on multiple factors, which may include delivery distance, service type, urgency level, package size or weight, time of day, operational demand, applicable taxes, regulatory surcharges, and platform service fees. All applicable fees and charges are disclosed to you before an order is confirmed.
All fees are stated in U.S. dollars and are non-refundable except as expressly provided in these Terms or as required by applicable law. Once an order is confirmed and accepted by a Driver, you are responsible for the full amount due, including any additional charges incurred as a result of inaccurate information, delivery changes, wait time, or failed delivery attempts caused by user error. Plight Hero reserves the right to modify pricing, fee structures, or service charges at any time.
Payments for Services are processed through third-party payment processors, including Stripe or other authorized providers. By submitting payment information, you authorize Plight Hero and its payment partners to charge your selected payment method for all applicable fees, taxes, and charges associated with your use of the Services. You agree to provide valid, current, and authorized payment information and to maintain sufficient funds or credit availability to cover all charges.
Verified Business Accounts may be eligible for invoicing and deferred payment options. Eligibility is determined at Plight Hero's sole discretion and may require business verification, credit review, and acceptance of additional billing terms. Deferred payment accounts are subject to established billing cycles, credit limits, and payment deadlines. Failure to pay invoices in full and on time may result in late fees, suspension of Services, revocation of deferred payment privileges, or referral to collections.
Cancellation fees may apply depending on the stage of the delivery at the time of cancellation. Failed deliveries caused by incorrect addresses, recipient unavailability, access issues, or user-provided errors may result in additional charges. Refunds and fee adjustments are evaluated on a case-by-case basis in accordance with Plight Hero policies. You must submit any disputes or refund requests within thirty days of the transaction date.
Drivers who use the Plight Hero platform do so strictly as independent contractors. Drivers are not employees, agents, partners, joint venturers, or representatives of Plight Hero, LLC for any purpose. Nothing in these Terms creates an employment relationship or fiduciary duty between Plight Hero and any Driver. Drivers retain full discretion over whether, when, and how often they use the Services, subject only to platform rules and applicable law.
Plight Hero does not control the manner or means by which Drivers perform delivery services. Drivers are solely responsible for determining how deliveries are completed, including routes taken, tools used, and operational decisions, except where specific platform requirements apply for safety, compliance, or service integrity.
Drivers expressly consent to background screening, which may include criminal history checks, driving record reviews, identity verification, and ongoing monitoring, to the extent permitted by law. Drivers who fail to meet, maintain, or consent to these requirements may be denied access to the platform or removed at any time. Drivers must maintain a valid driver's license, active vehicle registration, and insurance coverage that meets or exceeds state and local legal requirements.
Drivers agree to perform delivery services in a professional, lawful, and safe manner at all times. This includes complying with all traffic laws, transportation regulations, safety standards, and delivery instructions provided through the platform. Drivers are responsible for the secure handling of items during pickup, transport, and delivery, and for following verification procedures when required.
Driver earnings are calculated based on factors such as delivery distance, service type, time, demand, and applicable incentives. Earnings may also include customer tips where applicable. Payments to Drivers are processed through third-party payment providers and are subject to verification of completed deliveries and compliance with these Terms. Drivers are solely responsible for all tax obligations arising from their earnings.
Drivers assume all risks associated with providing delivery services, including risks related to vehicle operation, traffic incidents, personal injury, and property damage. Plight Hero does not guarantee insurance coverage for Drivers and does not replace or supplement personal or commercial insurance policies required by law. Drivers are encouraged to maintain adequate insurance coverage to protect against liability, loss, or damage arising from delivery activities.
All rights, title, and interest in and to the Services, including but not limited to the website, mobile applications, software, systems, technology, databases, content, text, graphics, logos, trademarks, service marks, designs, interfaces, and all related materials, are owned by or controlled by Plight Hero, LLC or its licensors and are protected by applicable intellectual property laws in the United States and internationally.
Nothing in these Terms transfers ownership of any intellectual property to you. You may access and use the Services only for lawful purposes and only as intended by Plight Hero. You may not copy, reproduce, distribute, modify, publish, transmit, display, sell, sublicense, rent, lease, reverse engineer, decompile, disassemble, or otherwise exploit any portion of the Services without prior written authorization from Plight Hero.
You may not remove, alter, or obscure any copyright, trademark, or proprietary notices displayed on or within the Services. Any unauthorized use of Plight Hero's intellectual property, branding, or materials may result in immediate suspension or termination of your access to the Services and may subject you to legal action. If you submit feedback, suggestions, ideas, or recommendations regarding the Services, you acknowledge that such submissions are voluntary and that Plight Hero may use them without restriction, obligation, or compensation to you.
When you access or use the Services, you acknowledge and agree that Plight Hero collects, uses, processes, and stores personal and business information as necessary to operate, maintain, and improve the Services. This includes information required to create accounts, process deliveries, complete payments, provide customer support, comply with legal obligations, and ensure the safety and integrity of the platform.
The types of information collected may include, but are not limited to, names, contact details, delivery addresses, location data, payment information, device and usage data, and communications exchanged through the platform. For Drivers and Business accounts, this may also include identity verification information, business credentials, and compliance-related documentation. Location data may be collected in real time when required to enable routing, tracking, delivery confirmation, and operational support.
Plight Hero uses reasonable administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, or alteration. However, no system can be guaranteed to be completely secure. Plight Hero may share information with trusted third-party service providers when necessary to deliver the Services. Plight Hero may also disclose information when required to comply with applicable laws, regulations, legal processes, court orders, or governmental requests.
You are responsible for ensuring that any information you provide through the Services is accurate and up to date. You may request access to, correction of, or deletion of your personal information, subject to legal, regulatory, and operational requirements. By using the Services, you consent to the collection, use, and disclosure of your information as described in this Section and in the Plight Hero Privacy Policy.

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable law, Plight Hero disclaims all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, reliability, availability, and non-infringement.
Plight Hero does not guarantee that deliveries will be completed within a specific time frame, that the Services will be uninterrupted or error-free, or that any item will be delivered without delay, damage, loss, or interruption. Delivery times, routing, availability of Drivers, and tracking information are estimates only and may be affected by factors outside of Plight Hero's reasonable control.
To the maximum extent permitted by law, Plight Hero, its affiliates, officers, directors, employees, agents, contractors, and service providers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Services. This includes, without limitation, damages for lost profits, lost revenue, business interruption, loss of data, loss of goodwill, delivery delays, missed deadlines, personal injury, property damage, or loss or damage to goods.
In all cases, Plight Hero's total cumulative liability for any claim, dispute, or cause of action arising out of or relating to the Services shall not exceed the total amount actually paid by you to Plight Hero for the specific delivery or transaction giving rise to the claim. If no payment was made, Plight Hero shall have no liability. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, Plight Hero's liability will be limited to the maximum extent permitted by applicable law.
You agree to defend, indemnify, and hold harmless Plight Hero, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use or misuse of the Services, your violation of these Terms or applicable law, the items you request to be delivered, inaccurate, incomplete, or misleading information you provide, or your interactions with Drivers or other Users. This indemnification obligation will survive termination of your account or cessation of use of the Services.
These Terms, your use of the Services, and any dispute, claim, or controversy arising out of or relating to the Services or these Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
Before initiating any formal legal proceeding, you agree to make a good-faith effort to resolve any dispute informally by contacting Plight Hero and providing a written description of the issue and the relief sought. Plight Hero will make reasonable efforts to respond and attempt to resolve the matter within a reasonable period of time.
Except where prohibited by applicable law, any dispute, claim, or controversy that cannot be resolved informally shall be resolved through binding arbitration on an individual basis. Arbitration shall be conducted in accordance with the rules of a nationally recognized arbitration organization, and may take place in Palm Beach County, Florida, or remotely, at Plight Hero's discretion. The arbitrator shall have exclusive authority to resolve all disputes, including the enforceability and interpretation of these Terms.
You and Plight Hero agree that arbitration will be conducted only on an individual basis, and not as a class, collective, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Plight Hero.
Nothing in this section prevents Plight Hero from seeking injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property, confidential information, platform integrity, or to prevent unauthorized use of the Services. If arbitration is not permitted by law for a particular claim, or if a claim is excluded from arbitration, you agree that such claim shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction and venue in those courts.
These Terms, together with the Plight Hero Privacy Policy and any additional policies or agreements expressly incorporated by reference, constitute the entire and exclusive agreement between you and Plight Hero regarding your access to and use of the Services. They supersede and replace all prior or contemporaneous agreements, communications, representations, or understandings, whether written or oral, relating to the subject matter herein.
If any provision of these Terms is determined by a court or arbitrator of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be severed from these Terms and the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be interpreted to the maximum extent permitted by law to reflect the original intent of the parties.
The failure of Plight Hero to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Plight Hero to be legally effective.
You may not assign, transfer, or delegate your rights or obligations under these Terms without prior written consent from Plight Hero. Plight Hero may freely assign or transfer these Terms, in whole or in part, including in connection with a merger, acquisition, sale of assets, or corporate restructuring.
Plight Hero shall not be liable for any failure or delay in performance of the Services resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, severe weather conditions, pandemics, labor disputes, acts of terrorism, war, civil unrest, governmental actions, power outages, internet or telecommunications failures, or failures of third-party service providers.
Plight Hero reserves the right to update, modify, amend, or replace these Terms at any time, in its sole discretion. When changes are made, Plight Hero will update the "Last Updated" date at the top of these Terms and publish the revised version through the Services. Unless otherwise stated, all modifications become effective immediately upon posting. Your continued access to or use of the Services after the updated Terms are made available constitutes your acceptance of the revised Terms.
Any provisions of these Terms that by their nature should survive termination or expiration shall survive, including but not limited to sections relating to payments, limitation of liability, indemnification, dispute resolution, governing law, and intellectual property.
